Terms of Service

Effective date: September 30, 2026

These Terms govern your use of nextlevelbids.ca and your purchase or use of services from Next Level Bids. By using the website, submitting an inquiry, booking a meeting, or purchasing a service, you agree to these Terms.

Services

Next Level Bids may provide services to government institutions, public-sector organizations, private-sector suppliers, procurement teams, and other organizations.

Services may include proposal review, RFP support, bid management, mock evaluation, compliance review, bid strategy, procurement planning, RFP development, RFP review, procurement advisory support, evaluation-process support, fairness monitoring, procedural fairness support, and procurement training.

The exact services included in a purchase are limited to the product description, checkout information, written proposal, statement of work, or separate written agreement applicable to that purchase.

Role limitations

The role Next Level Bids performs will be defined in the applicable written engagement. A client must not assume that Next Level Bids is acting as legal counsel, a procurement authority, an evaluation decision-maker, a government representative, a supplier advocate, or a fairness monitor unless that role is expressly accepted in writing.

Government-side services

When engaged by a government or public-sector client, Next Level Bids may assist with procurement planning, requirements development, RFP drafting, evaluation materials, procurement procedures, training, process review, and related advisory services.

The client remains responsible for its authority, approvals, procurement decisions, legal compliance, records, communications, evaluation decisions, contract award, and final publication or submission of procurement documents.

Fairness monitoring

When engaged as a fairness monitor or procedural fairness advisor, Next Level Bids acts independently and objectively within the agreed mandate. A fairness monitor does not advocate for a government institution or supplier, does not make the procurement decision, and does not guarantee a particular procurement outcome.

Supplier-side restrictions

A client that receives supplier-side support must not assume that Next Level Bids can support the client on an opportunity where Next Level Bids has provided government-side services relating to the same or a substantially related procurement.

Conflict rules

Next Level Bids may work for government clients and supplier clients on unrelated procurements. It will not knowingly act for both sides on the same procurement or substantially related work where the roles could create an actual, potential, or reasonably perceived conflict.

If a conflict is identified, Next Level Bids may decline the engagement, end the engagement, establish information barriers, limit the scope of work, obtain written consent where appropriate, or take another reasonable step to protect the integrity of the process.

No guaranteed outcome

Next Level Bids does not guarantee that a client will win an RFP, be shortlisted, receive a contract, obtain a particular score, or achieve a particular financial result.

Procurement outcomes depend on the issuing organization, competing suppliers, evaluation decisions, pricing, compliance, market conditions, and other factors outside our control.

Client responsibilities

You must provide accurate, complete, and timely information. You are responsible for providing relevant documents, identifying mandatory requirements, confirming factual accuracy, obtaining permission to share documents, making final business and legal decisions, and meeting all submission deadlines.

We may rely on information you provide. Delays or incomplete information may affect the scope, timing, and quality of the work.

Professional limitations

Our services are advisory and commercial in nature. They are not legal, accounting, tax, engineering, cybersecurity, or regulatory advice. You should obtain advice from an appropriately qualified professional when required.

Fees and taxes

Prices are stated in Canadian dollars unless otherwise indicated. Applicable taxes may be added at checkout. You are responsible for paying all amounts shown at checkout and any approved additional work.

Additional work

Work outside the purchased scope requires your approval and may be billed at the applicable hourly rate or under a separate agreement. Next Level Bids is not required to perform work beyond the purchased scope without written approval.

Confidentiality

We will use reasonable care to keep non-public business information confidential and will use it only to provide the requested services, administer the relationship, protect our rights, or comply with legal obligations.

This obligation does not apply to information that is public, independently developed, lawfully received from another source, or required to be disclosed by law.

Intellectual property

You retain ownership of documents and information you provide. Unless otherwise agreed, Next Level Bids retains ownership of its pre-existing methods, templates, frameworks, know-how, processes, and general tools.

You receive a non-exclusive right to use final deliverables for your internal business and proposal purposes.

Limitation of liability

To the maximum extent permitted by law, Next Level Bids will not be liable for indirect, incidental, special, consequential, exemplary, or lost-profit damages. Our total liability for a service will not exceed the amount you paid for that service.

Nothing in these Terms excludes liability that cannot legally be excluded or limited.

Third-party services

The website and services may rely on third-party platforms, including payment processors, scheduling tools, hosting providers, email services, and other technology providers. We are not responsible for outages, delays, errors, or changes caused by third-party services.

Suspension or refusal

We may refuse, suspend, or discontinue service where necessary to prevent abuse, fraud, unlawful activity, conflicts of interest, unsafe conduct, non-payment, or unreasonable demands.

Governing law

These Terms are governed by the laws of Ontario and the applicable laws of Canada. Any dispute will be addressed first through good-faith discussion. If it cannot be resolved, the courts of Ontario will have jurisdiction.

Changes

We may update these Terms by posting a revised version on this website. The updated version applies to future purchases unless a separate written agreement states otherwise.
